Terms of Service
Last updated: [PUBLICATION DATE]
These Terms govern your use of agentcsecurity.com (the “Site”), operated by Agent-C Security, LLC, a Tennessee limited liability company (“Agent-C,” “we,” “us”). By using the Site you agree to them. If you don’t agree, please don’t use the Site.
1. What these Terms cover — and what they don’t
These Terms govern the website only.
If you engage Agent-C to perform a Checkup or any other work, that engagement is governed by a separate written services agreement signed by both of us. That agreement — not this page — defines scope, authorization to test, deliverables, fees, confidentiality, and liability for the work itself.
Nothing on this Site, and nothing you submit through it, creates an engagement, a contract for services, or any obligation for either of us to proceed. Requesting a Checkup is a conversation, not a purchase.
2. Pricing shown on the Site is not an offer
Prices displayed as “from $X” are starting points, not quotes. Every codebase is different: a single small repository and a multi-service production system are very different amounts of work. The price for your engagement is the one stated in a written proposal or services agreement you accept. We may change published pricing at any time without notice, and published pricing does not bind us to any particular engagement.
3. What the Site is — and is not
The Site describes an assessment service and explains our methodology. Its content is general information, not professional, legal, security, or compliance advice, and it is not tailored to your system.
Specifically:
- A score is not a guarantee. The Agent-C Checkup evaluates a system against a defined rubric, at a point in time, within an agreed scope. A high score means the things we examined met the criteria we applied. It does not mean your system is secure, cannot be breached, or complies with any law, standard, or contract. No assessment of any kind can establish that.
- A Letter of Attestation describes what we assessed and what we found. It is not a certification, an audit opinion, an insurance product, or a warranty, and it is not issued under any accreditation scheme.
- Standards we reference — including OWASP ASVS and PTES — inform our methodology. Referencing them does not mean we are endorsed by, certified by, or affiliated with the organizations behind them.
4. The sample report
Any sample report or example scorecard we provide is illustrative. It is redacted, anonymized, or constructed for demonstration, and it does not describe any identifiable client or real system. Do not rely on it as a statement about any actual product, company, or security posture, including your own.
5. The platform waitlist
We may invite you to join a waitlist for a future self-serve platform. A waitlist is an expression of interest and nothing more. We make no commitment that the platform will launch, when it will launch, what it will do, or what it will cost, and joining creates no right to access, pricing, or priority.
6. Acceptable use
You may read, share, and link to the Site freely. You may not:
- Test, scan, probe, fuzz, benchmark, or attempt to circumvent the security of the Site or its hosting, or perform any penetration testing against it, without our prior written permission;
- Attempt to gain unauthorized access to any part of the Site, its infrastructure, or any data;
- Introduce malware, or interfere with the Site’s availability or integrity;
- Scrape or harvest the Site by automated means beyond ordinary search-engine indexing;
- Use the Site to send unsolicited commercial messages, or submit false information through any form;
- Reproduce our written content, rubric, or scoring framework as your own, or use them to build a competing assessment product.
Found something anyway? We would genuinely rather hear about it than not. Email security@agentcsecurity.com with the details and give us reasonable time to fix it before disclosing publicly. We will not pursue legal action against anyone who reports a vulnerability in good faith, acts only to the extent necessary to demonstrate it, does not access or modify data belonging to others, and does not degrade the service for anyone else. We do not currently pay bounties.
7. Intellectual property
The Site’s text, design, graphics, the Agent-C Checkup methodology, the eight-dimension maturity rubric and its scoring bands, and the Agent-C name and logo are owned by Agent-C Security, LLC and protected by intellectual property law. We grant you a limited, revocable, non-exclusive licence to view and use the Site for your own evaluation purposes. Everything not expressly granted is reserved.
Third-party names and marks appearing on the Site belong to their owners and are used descriptively.
8. Third-party links
The Site may link to sites we don’t control. We’re not responsible for their content, their practices, or what happens to you there. Their terms and privacy policies govern, not ours.
9. Submissions
If you send us feedback, suggestions, or ideas about the Site or the service, you grant us a perpetual, worldwide, royalty-free licence to use them without obligation or compensation. Please don’t send us anything confidential through the Site — the Site’s forms are not a secure channel for sensitive material, credentials, or proprietary code. Confidential exchange happens under the services agreement, with the protections that agreement provides.
10. Disclaimer of warranties
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be uninterrupted, timely, secure, error-free, or that its content is accurate, complete, or current.
Some jurisdictions don’t allow certain exclusions, so parts of this section may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, Agent-C Security, LLC and its member, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or reputational harm, arising out of or relating to your use of the Site — even if we’ve been advised such damages are possible.
Our total aggregate liability arising out of or relating to the Site will not exceed one hundred U.S. dollars ($100.00).
This section is about the Site. Liability for a paid engagement is addressed in the services agreement for that engagement.
Some jurisdictions don’t allow these limitations, so parts of this section may not apply to you.
12. Indemnity
You agree to indemnify and hold harmless Agent-C Security, LLC and its member, officers, employees, and contractors from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising from your misuse of the Site or your breach of these Terms.
13. Governing law and venue
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-laws principles. Any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Davidson County, Tennessee, and you consent to personal jurisdiction there.
14. Changes
We may update these Terms. When we do, we’ll change the “Last updated” date above. Material changes take effect when posted; continuing to use the Site after that means you accept them. We don’t apply changes retroactively to a dispute that already arose.
15. Severability and entire agreement
If any provision is held unenforceable, the rest stays in force and the unenforceable provision is limited to the minimum extent necessary. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site. Our failure to enforce a provision isn’t a waiver of it.
